PRESS RELEASE: Regulate Smarter Praises FDA Authorization of New ENDS Product, Urges Further Action

FDA must advance reforms to its review process and harness the potential of innovation and technology of lower-risk smoke-free products for adult consumers while continuing to enforce against the illicit market
WASHINGTON, D.C. – Today, former U.S. Senator Richard Burr (R-NC), chairman of the Coalition for Smarter Regulation of Nicotine (Regulate Smarter), issued the following statement after the U.S. Food and Drug Administration (FDA) authorized four flavored electronic nicotine delivery systems (ENDS) through the premarket tobacco product application (PMTA) pathway:
“While the authorization of flavored ENDS products is a positive step, fundamental reforms are needed to the review and authorization process of less harmful products to give adult consumers access to the smoke-free options they are seeking,” said Burr. “President Trump and Secretary Kennedy deserve tremendous credit for their leadership that has driven combustible smoking rates to new lows. Through both authorizations and enforcement, now is the time to get tough on the illicit vapor product market – most of which comes from China – and fully harness the innovation and technology of lower-risk, smoke-free products. Hopefully, a new day is dawning at the FDA with a renewed focus on reviewing and authorizing more legal products that provide adult consumers better and more meaningful choices, protect against youth access, and reverse the influx of illicit Chinese product overrunning our streets and store shelves with aggressive enforcement.”
